(WHNT) – Governor Robert Bentley is speaking out regarding a recent roadside study in Bibb and St. Clair counties that occurred in the overnight hours this past weekend. People were asked for a throat swab, a blood sample and to undergo a breathalyzer test.

Our news partner, AL.com, reports participation was voluntary and anonymous. Drivers were reportedly paid for their participation.

AL.com reports off-duty deputies in the counties stopped traffic to ask drivers to participate in the study. The study leads to concerns not only among residents, but Alabama’s Attorney General and Governor as well

Yeah, it was voluntary.  Police officers, in uniform, using police cars, with blue lights, stopping motorists and asking them to participate in a survey that involves collecting blood, saliva and DNA.  

 

Doesnt matter that they were 'off duty' and 'off the clock'.  Ever hear of 'under color of law' - The act of a state officer, regardless of whether or not the act is within the limits of his or her authority, is considered an act under color of law if the officer purports to be conducting himself or herself in the course of official duties. - ie officer is in uniform and using police cars to initiate the road block.
