Some of the documents that FBI agents retrieved after searching Mar-a-Lago were so classified that investigators needed special permission to view them, according to Justice Department court documents filed Tuesday.

The 36-page filing came as a response to former President Donald Trump's lawsuit last week requesting that a court-appointed "special master" be tasked with reviewing the materials the FBI seized after executing a search warrant at his Florida home on August 8.

In addition to detailing the highly classified nature of some records that were recovered, the DOJ also revealed that it suspects there were efforts to obstruct its investigation into the former president's handling of national security information, and the haphazard way that documents were stored at Mar-a-Lago.

"In some instances, even the FBI counterintelligence personnel and DOJ attorneys conducting the review required additional clearances before they were permitted to review certain documents," the filing said.

The department also attached exhibits to its filing, one of which was a photo showing some documents marked "contains sensitive compartmented information up to HCS-P/SI/TK." "HCS" refers to intelligence from clandestine human sources and is highly classified to protect their safety.

The Director of National Intelligence, Avril Haines, recently told lawmakers that her office is leading an investigation into the possible national security risks that would arise if the records had been disclosed or fell into the wrong hands.

Trump, for his part, has railed against the FBI in the weeks since the raid and also claimed that he had broadly declassified all the documents.

However, the Justice Department noted in its filing that Trump never asserted executive privilege or said anything was declassified in conversations preceding the search of his Florida estate. CNN also recently interviewed 18 former Trump administration aides and officials, none of whom said they were aware of any standing declassification order.

More importantly, even if Trump had declassified the materials in his possession, it likely wouldn't matter.

Section E of the Espionage Act, one of the three laws Trump is suspected of having violated, makes it a crime to retain any government records pertaining to the US's national defense, regardless of classification level.

The other two federal statutes Trump's suspected of having broken — 18 USC Section 2071 and 18 USC Section 1519 — criminalize the concealment, removal, and destruction of government records, also regardless of classification level.

Investigators took the extraordinary step of seeking a search warrant against the former president after obtaining evidence that there may have been efforts to hamper its investigation into Trump's handling of government records.

In Tuesday's filing, the Justice Department detailed months of back and forth between US officials and Trump's team in which Trump and his representatives continuously resisted handing over the records that were improperly moved to Mar-a-Lago once he left office.

The government also "developed evidence" that official documents were "likely concealed and removed" from a storage room at Mar-a-Lago "and that efforts were likely taken to obstruct the government's investigation," the filing said.

Trump has sought to portray the search as politically motivated, and has applied to have the special master review the documents because he claims that many were covered by executive privilege and ought to be returned to him.

The Justice Department refuted that claim in its Tuesday filing as well, saying that Trump isn't entitled to a special master because the records in question "don't belong to him" and are the property of the US government.

Trump admits the documents were there, then claims the FBI planted them.. and the rubes still keep on buying it. The "patriots' want a messiah so bad, they'll overthrow Democracy to get it.

You really ought to send a bill to Trump. He's been living rent free in your mind for all this time and you have nothing to show for it other than continual anger and disgust for a person you obviously don't know personally but only take cues about who he is from obviously biased people. I don't know Trump either, I don't know the man personally. I do know under his administration America was totally energy independent and every decision made was made to put America's interest first and the southern border was somewhat under control. That's really the only thing I know about Trump and frankly that's not bad things.

Since you seem to be so concerned about national security, documents, information, I'm sure you apply the same standard to Hillary Clinton that you do Donald Trump?

1. Under Trump, the US was totally energy independent.... you'll have to clarify what you mean. imports/exports... energy produced/energy used.... what's the reference....

2. every decision made was to put America's interests first...
yep.. withholding aid to the Ukraine worked out definitely in our best interest.. yep... that's just one example...

3. The southern border is now out of control... name the policy that made it 'out of control'... what did Biden do to 'make the southern border out of control'???? you specifically mentioned it, so you must have a reason....
hint: no Trump policy , on our southern border, has been changed.

Now.. back to the same old cry from Republicans for the last 5 years 'But Her emails'....

The Feds didn't charge Hillary with any crimes because they couldn't find evidence of criminal wrongdoing.. Comey even criticized her anyway... quite possibly costing her the election.

Now.. the Feds are investigating Trump, so far Republicans have claimed ... political harassment... Trump declassified.. Trump was cooperating with the FBI... Trump was framed... Trump knew he had them and was talking about giving them back.... Trump was protecting them... and the list grows daily....

Republicans aren't even willing to discuss the severity of the information.. but sure ready to give Trump a pass .... seems funny after all those years of investigations into 'her emails'... doesn't it???

The man had Top Secret documents, in his desk, after his lawyer sent a signed affidavit to the contrary. Trump's lawyer has admitted there were records in his office.. and that 'Trump entertained people in that office all the time.'.... If this was Hillary, how about you tell me what the Republicans would have done by now???

Albert Einstein has been credited with a quote saying:  Insanity is doing the same thing, over and over again, but expecting different results.  There is no need to spend time researching, copying, and pasting anything in reply because either it will be discounted away, denied, or just outright rejected.  The great majority of members, who still come and read these forums, know very well how things have played out over time from Trump's administration to the Biden administration and are, sadly, living with the consequences and results of the policy changes.  If people are honest they will acknowledge that Trump wasn't perfect but was effective and did much that had our country headed to a better position and one which was beneficial for many.  Anyone who closely watches the news (several outlets and stations that is) and listens to Biden talk knows that the man is way past his prime.   The man isn't even speaking for himself but rather is seen as a loose cannon by those who surround him.   I fully believe that Biden is president in name only and that the actions of the president are being directed by some, that almost all Americans do not know, behind the scenes who tell and instruct Biden as to what to say and do. 

At times Biden, himself, will slip and reveal such when he goes off script and deviates from the directions and instructions that are given to him on his cue cards (notes).  He at times will say something and then admit that he's going to get in trouble for saying what he just said and that "they" will be angry at him.  This is a man whose mind isn't at home any longer but is being manipulated for the sake of power itself.  Anyone with a thinking mind can see and understand this.  The man is just acting out a script that is given to him.

As I read the responses that you make at times I often recall a quote that George Carlin once said. "The reason I talk to myself is because I’m the only one whose answers I accept.

I'm not saying that you are the only one, on the forum that this applies to but your replies are so predictable and expected that if there is a nugget of wisdom or information in them it will be generally missed or overlooked because people already know, in advance, what the responses will be.  Like many Democrats, there is never any condemnation of Democrat policies or admission that the results of Democrat/liberal policies are either hurting people or contrary to our government as founded, and worse no recognition that there does exist double standards in government and the media today but rather there is more an embracing of anything Democrat as infallible and perfect.
