If a driver's distracted driving while texting satisfies the burden of proof needed to prosecute for an existing law, such as improper lane usage, following too close or failure to yield right of way, I'll gladly write the ticket.

No breaks or warnings if your bad driving is the result of texting or talking on the phone.
I was coming up Jackson Rd. the other day and a car in the oncoming lane was weaving wildly back and forth between his lane and mine. I was like, oh God, let me make it past this idiot without having to drive in to the ditch! As he passed, and I went to give him the look of evil and fantasies of throat punches, he didn't even see it because he was busy texting. It's terrifying that idiots are out driving en masse.

So if this can be covered under reckless driving why is a new law/ban needed?

So if this can be covered under reckless driving why is a new law/ban needed?


Because of our politician's need to be perceived as doing something about a problem. So they pass a bill with grandiose wording with no forethought as to how it would be enforced.

I fully expect them to pass a law concerning texting while driving, and pull the teeth out of it. Something like making it a no points violation, or disallowing citations to be issued if it was a communication between parent and child...or some other nonsense.

I fear you are correct. Glad to know though that y'all do write tickets for "distracted driving".
I sure see a lot of it.
