Why is this just not considered reckless driving?

So if this can be covered under reckless driving why is a new law/ban needed?

Because of our politician's need to be perceived as doing something about a problem. So they pass a bill with grandiose wording with no forethought as to how it would be enforced.
I fully expect them to pass a law concerning texting while driving, and pull the teeth out of it. Something like making it a no points violation, or disallowing citations to be issued if it was a communication between parent and child...or some other nonsense.
