What about a "right to life" law in Tennessee? Just because someone is on your property or standing on your front porch would not give anyone the right to shoot and kill that person...the deputy thought the home owners were out of town, he probably wanted his girlfriend to see where "they" might be living if he purchased the home...people have different schedules and maybe the girlfriend had a day schedule and he decided to drive that night and show her...what if the deputy's car was broken down, flat tire...etc, and no cell phone service and he was going to approach the home for help!! Heck now he is needing a lift to the funeral home!!

But then again. If the trespasser had been obeying the law as it is written, you know the one he is sworn to uphold, he would be alive today.

Tennessee's law for trespass without force is civil rather than criminal. Nowhere in any of the dozen or so reports I've read has it been indicated that the slain man used force to gain access to the property. Even if force was used to gain access, it's at best a class C misdemeanor.

So it's ok with you to shoot somebody because of a civil case? Or a class C misdemeanor?

I got to start carrying more ammo then. Never know when I might need to shoot someone over a slander or libel suit. Wink

Um, there was no "no trespassing" sign that I could see in the pics only the advertisement to sell the house which is an invitation to come on the property basically. Granted going at night is odd, but I did drive bys all hours of the day of my house a lot before I decided to buy. Who knows he might have had something more planned like asking her to marry him and this would be where they would live or something romantic -- tragic now.

My prayers go out to all involved in this tragedy.
Just this past week I had a man come knocking on my door at 1a.m I did not open my door, I informed him the person he was looking for no longer lives here (I've been here for almost 3 years). When someone comes to my door or is in my yard my first instinct is not to harm them nor do I feel anyone is trying to harm me. I do not own a gun as I do not like guns. If the deputy had been trying to gain access inside the home I could see the homeowner defending himself, but it doesn't sound like he was trying to enter the home. I hope this homeowner feels very remorseful and I do think he should be charged with something,an innocent man is dead. He could have just called the police instead he decided to take the law into his own hands.

This officer worked from 4:00 p.m. in the afternoon until 6:00 a.m. in the morning, according to WHNT-19 Newscast; therefore, his "days" were most people's nights. The shooter apparently lived in Florida and the victim, believing the residence was empty, was showing it to his girl friend. Grand Jury will have all the evidence...could be something like, "Criminally Negligent Homicide".
