Harris drive is the main entrance? There's a bad curve there at the intersection with Lakewood, but I would have expected an accident there to be due to someone turning left in front of oncoming traffic.

People do drive to fast down that road, and incidentally, some of the mailboxes are too close to the road.
Hey kids...I commented on this without looking at the date. I made the mistake of thinking that since it was near the top of the pile, it was brand new.

I just talked to a relative in Kendale Gardens and found out that this didn't happen this morning, and that a lady wrecked her car. So, I want to tell y'all that I didn't know any details when I said that people drive too fast on that road. I don't want anyone to think I knew the details of the wreck and was saying this was the case in this specific instance.

I hope the lady is doing well.

hspg just asked a question. Perhaps she/he was concerned for the neighbors. Just a thought from another person who frequently works from home.

Ok, so thanks to all the replies. This forum is for discussion and I got some discussion! BTW, I too work for a living and my husband just happened to be working from home that day. I have found out from the neighbors that it was in fact a single car accident and that a dog was at fault. Apparently the driver was trying to avoid a dog and flipped her car. Which brings me to my soap box--keep your dog in your yard!! Harris speedway, as we like to refer to it, is the prime place for accidents involving car vs. dog!

It is hard to make yourself hit an animal. It happens so fast and the reflex is to swerve.

Would the dog owner be subject to any liability in a case like this? Or would it depend on the leash laws in the area.

Alabama state law prohibits dogs from running at large in counties that adopt the following regulation:

Section 3-1-5
Permitting dogs to run at large; applicability of provisions of section in counties and certain cities or towns.

(a) Every person owning or having in charge any dog or dogs shall at all times confine such dog or dogs to the limits of his own premises or the premises on which such dog or dogs is or are regularly kept. Nothing in this section shall prevent the owner of any dog or dogs or other person or persons having such dog or dogs in his or their charge from allowing such dog or dogs to accompany such owner or other person or persons elsewhere than on the premises on which such dog or dogs is or are regularly kept. Any person violating this section shall be guilty of a misdemeanor and shall be fined not less than $2.00 nor more than $50.00.

(b) This section shall not apply to the running at large of any dog or dogs within the corporate limits of any city or town in this state that requires a license tag to be kept on dogs nor shall this section apply in any county in this state until the same has been adopted by the county commission of such county.



Lauderdale County has adopted this. That said, I can't see a jury finding a dog owner guilty of negligence from a dog being in a street.
